Terms & Conditions

By booking a session with Rook Barber Photography, you agree to the following terms & conditions.

--------------------------------------------------------------

Booking & Retainer

A non-refundable session fee is required to secure your date. This fee is paid in full upon booking and covers planning, preparation, & a base set of deliverables. Once paid, the session is reserved exclusively for you, and other bookings are declined for that time. Under no circumstances will this fee or any subsequent payment be refunded.

Payment

All balances must be cleared before editing begins. Final deliverables are not released until the project is fully paid.

Rook Barber Photography reserves the right to withhold all deliverables until full payment has cleared.

Incidentals may include additional editing, specialized file preparation, travel, production adjustments, or other costs that arise before, during, or after your session. Incidentals such as travel, props, wardrobe, rentals, assistants, or other fees are invoiced the next business day after your session and must be paid in full before final delivery.

After 6 months from the original session date, all payments are forfeit.

Deliverables

All final photos are delivered as high-resolution JPEGs through a private online gallery. RAW files are not included in standard deliverables but may be purchased for an additional fee.

Videos are filmed on an iPhone 16 Pro Max and delivered as digital files in a professional format suitable for online sharing or presentation.

Only edited, finalized work is provided. Unedited or incomplete files are not released.

Content Delivery Timeline

Standard turnaround is 4–6 weeks from proof selection date for photos and 6–8 weeks from session date for videos. Delivery timelines may be extended during high-volume periods, by delays in the client’s proof or selection process, or by the level of work required to bring the content to a mastered standard. Rush options are available at published rates.

Rescheduling & Lateness

Rescheduling due to illness or emergency with at least 7 days’ notice will transfer your retainer to a new date within 6 months of the original session date. Proof may be required for emergency claims.

Other reschedules are subject to a reschedule fee.

Late arrivals reduce shooting time. Overtime beyond the agreed session duration will be billed at $100 per hour plus $50 per hour per assistant. If meals are provided to others on set, the client must provide meals to the photographer and any assisting team members.

Operational Impact Fees

Operational impact fees apply when a session or event disrupts scheduling, pre-arranged travel, or previously booked commitments. These fees may range in cost depending on the scope of the disruption. A fee framework is available upon request.

Cancellation

All monies paid are non-refundable under any circumstances. If you cancel your session, all fees are forfeited. Rescheduling within 6 months of the original session date may be possible, pending availability.

File Management & Archiving

Online galleries are guaranteed for 3 months after delivery. After that period, galleries may be deleted at the photographer’s discretion.

Seasonally, all galleries are reviewed & archived. After 1 year, all files may be deleted. It is the client’s responsibility to download & store their files after delivery. The photographer holds no responsibility for maintaining files beyond the guaranteed 3-month gallery hosting period.

Retrieving files, if still in existence, after removal from active storage may incur fees.

The client has two (2) days after gallery delivery to raise any technical or content-related concerns. After that period, no re-edits, or re-shoots will be offered, without additional fees.

Sensitive Content

Content deemed sensitive in nature (such as swimwear or intimate sessions) is not shared, published, or displayed without the client’s explicit written consent. Sensitive content is typically destroyed once delivery is complete but may take up to 6 months depending on workload. At any time, a client may request deletion of files, and the photographer will make every reasonable effort to remove all copies from active & backup systems within 30 days.

Exclusivity on Set

Only the photographer & their assistant may capture posed scenes, setups, or lighting compositions during the session. Sessions may include assistants, stylists, or other contracted team members working under the photographer’s direction. These individuals are covered under the same protections, rights, and safety terms as the photographer.

Discretion & Substitution

The photographer is not responsible for missed moments due to lateness, location restrictions, or weather. The photographer is not liable for lighting issues, background constraints, or unrequested coverage. If services cannot be rendered due to force majeure, a reshoot will be scheduled within three (3) months at no additional cost. A comparable substitute photographer may be used at the photographer’s discretion. The photographer may end coverage if threatened or unsafe conditions arise; only completed work will be delivered. The client releases the photographer from liability related to personal injuries on site.

File Loss Limitation

In the rare event of file loss due to equipment failure beyond the photographer’s control, liability is limited to the total amount paid under the agreement.

Artistic Control

The photographer maintains full discretion in image selection, final editing style, & artistic direction. The client may not upload, submit, or use any images or videos from Rook Barber Photography in AI systems, datasets, or generative tools without written consent.
